The legislation is built on a risk-based model: the greater the potential impact an AI system can have on people's rights and safety, the stricter the requirements. High-risk systems, for example in recruitment or credit scoring, are subject to extensive requirements around documentation, risk management and human oversight.

For most companies using AI in marketing and creative production — chatbots, content generation, personalisation — it's mainly about transparency requirements: users should be able to understand when they're interacting with or viewing AI-generated content, and in some cases AI-generated material must be labelled as such.

The requirements are being phased in through 2026-2027, giving companies time to adapt processes, but it's wise to build compliance into workflows now rather than postponing it.
